Terms and Conditions of Use and Sale

1. Site Operator

This site is operated by Saccuman Srl, registered office in Bolzano, Via Alessandria 23 — VAT No. IT00510340219 — Duns Number 439212986. E-mail: shop@saccuman.it. Saccuman Srl owns the following websites: shop.saccuman.it, piano.saccuman.it, pianoforti-heilmann.it, bechstein-triveneto.it.

2. Purpose and Acceptance of Terms

These Terms govern access to, browsing of, and use of the Site and, where applicable, purchases made on it. By browsing or purchasing on the Site, you declare that you have read, understood and fully accepted these Terms. They apply both to Consumers (under Italian Legislative Decree 206/2005 - Consumer Code) and to businesses and professionals (B2B customers).

The Operator reserves the right to amend these Terms at any time: changes will be published on this same page, with the date of last update, and will be deemed accepted by continued browsing or by any purchase made after publication.

3. Intellectual and Industrial Property

All content on the Site — text, software, photographs, videos, graphics, trademarks and logos — is owned by Saccuman Srl or its licensors (the brands' manufacturers) and is protected by copyright, trademark and intellectual property law. Reproduction, copying, modification, distribution or publication of the Site's content without Saccuman Srl's written authorisation is prohibited.

4. User Conduct

You agree not to use the Site to:

transmit content that violates applicable law or these Terms;
impersonate other people or use someone else's credentials;
tamper with the Site's security or introduce viruses or other malicious code;
use automated tools (spiders, bots, scrapers) to monitor or copy content without written authorisation;
interfere with the proper operation of the IT infrastructure or servers, or engage in conduct that undermines the Site's commercial value.

5. Limitation of Liability

Site content is provided "as is" and "as available". Saccuman Srl does not guarantee the absence of errors or interruptions and is not liable for damages or lost profits arising from temporary malfunctions, service interruptions or technical/typographical errors, except in cases of wilful misconduct or gross negligence as provided by law.

The Site may contain links to third-party websites: Saccuman Srl has no control over such sites and is not responsible for their content or policies.

Saccuman Srl is not responsible for shipping and delivery times, which are the sole responsibility of the carriers (e.g. GLS, BRT), nor for any damage caused during transport; quality control is always carried out before shipment.

6. Account and Registration

Registering an account is required to make purchases, request quotes, or access reserved services (customer area, Rental, B2B area). Registration is reserved for those who have reached the age of majority. By clicking "Create your account" you fully accept these Terms.

You are responsible for keeping your login credentials confidential and for all activity carried out through your account. Saccuman Srl reserves the right to suspend or delete accounts in case of false information or breach of these Terms, without any obligation to compensate.

7. Terms of Sale — Guitars, Basses and Accessories

For products purchasable directly online (e.g. guitars, basses, accessories), prices and availability are shown on the relevant product page at the time of order. Accepted payment methods (PayPal, Amazon Pay, or Cash where available) and related conditions are shown at checkout.

Right of withdrawal: if you purchase as a Consumer, you have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason, as described on the Right of withdrawal page, which forms an integral part of these Terms.

Warranties: products are covered by the statutory conformity warranty provided by the Consumer Code for Consumers (24 months) and by any manufacturer's warranty, where indicated on the product page.

8. Pianos — Price on Request

Pianos shown on the Site (Piano/PianoShop, Bechstein and Heilmann worlds) cannot be purchased directly online: every product page shows "Price on request" and lets you send a quote request, which is handled directly by one of our staff outside the Site. These Terms nonetheless apply to browsing the online catalogue; the specific sale, delivery and warranty conditions for pianos (including extended warranties of up to 5 years on eligible products) are communicated and agreed separately during the negotiation.

9. Rental

For instruments available for rental, the specific contractual terms (duration, fee, any security deposit, return procedure) are set out in the relevant rental contract, which supplements and prevails over these Terms for the matters it specifically governs.

10. Professional and Business Customers (B2B)

Users who register as a business or professional (B2B account) declare that they are acting in the course of their business or professional activity and therefore do not benefit from the protections the Consumer Code grants to Consumers (e.g. the 14-day right of withdrawal), unless otherwise agreed in writing. For such customers, the limitation-of-liability clause (Section 5) and the jurisdiction clause (Section 11) are specifically approved pursuant to and for the purposes of Article 1341, second paragraph, of the Italian Civil Code.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law.

For Consumers: the competent court is that of the consumer's place of residence or domicile, under Legislative Decree 206/2005.

For Professionals and Businesses (B2B customers): the exclusive competent court is that of Bolzano.
